Leo Group International v Rusworth - it is not a role of the employment tribunal to save a represented party from the consequences of how he has chosen to run his case - Court of Appeal 22.5.08
Mr Rushworth, dismissed when the business he worked for was sold to Leo, claimed unfair dismissal based on TUPE.
Leo produced no documents or statements - it totally ignored the employment tribunal's case management orders (which Mr Rushworth fully obeyed) save to continually seek postponements of deadlines. On the day of the hearing it sought an adjournment. The tribunal refused, and the hearing went ahead with the employers giving no evidence. The tribunal concluded that TUPE had applied and that Mr Rushworth (and others) had been unfairly dismissed.
