Basic Solutions Ltd v Sands - balance of convenience against granting injunction where only real aim was generally to limit competition - QBD 23.6.08

Mr Sands gave 6 months' notice to basic in September 2007, and for all practical purposes left in December 2007 after going sick. Basic intended to market "Track Grip" to Network Rail. It then learnt, in April 2008, that Mr Sands had joined another company (his son's) after his notice period expired and was intended to market a very similar product "Super Grip". Basic therefore sought an injunction against him, alleging breaches of express contractual provisions or else obligations of confidence arising by implication.
