Förster v IB-Groep ECJ Case 158/07 - protection for worker's right of freedom of movement could extend to cover entitlement to study pay - AG's Opinion 10.7.08

German national Ms Förster moved to the Netherlands to pursue her studies. Initially she performed paid work there. The relevant Dutch authorities (IBG) refused to pay for her studies once she stopped doing this. It considered that she was no longer economically active and so neither retained the status of a "Community worker" nor met the domestic law requirement of lawful residence in the Netherlands for a continuous period of at least five years.
