Selvarajan v Wilmot & Others - unreasonable delay in complying with statutory disciplinary procedures cannot, of itself, cause them to be deemed "not completed" - Court of Appeal 23.7.08
The EAT's judgment in this case was that breach of the general requirement to carry out statutory disciplinary procedures within a reasonable time would amount to their non-completion. This would make a dismissal automatically unfair. This was so even though all steps of the procedure had (eventually, after 4 months) been taken. In so concluding it was following a long line of EAT decisions.
The Court of Appeal has now disagreed with that conclusion, and allowed the employer's appeal..
