Graham v Nexia Ltd - when can an appeal proceed before the Court of Appeal? - Court of Appeal 29.7.08

An employment tribunal dismissed Mr Graham's complaints of disability discrimination and unfair dismissal against Nexia and the UKAEA. The EAT dismissed his appeals, with HHJ Birtles concluding that he could find no point of law arising from the decision of the employment tribunal. Mr Graham sought leave to appeal to the Court of Appeal.


Mummery LJ refused him leave, there being no point of law warranting a full appeal hearing. In so doing he gave this helpful summary of the nature of appeals:
