Commission of the European Communities v Republic of Austria - derogations from the freedom of movement of workers cannot be used so as to restrict freedom of establishment - ECJ Case 161/07 AG's Opinion 18.9.08

When the "new" member states acceded to the European Union in 2004 a 5-year "transitional period" was allowed, during which member states were allowed derogations from the freedom of movement of workers in respect of those new member states.
