Zalewska v Department for Social Development (Northern Ireland) - restrictions on right of freedom of movement to and residence in EU state were legitimate and proportionate - House of Lords 12.11.08
The Northern Ireland Court of Appeal agreed with a decision of a Social Security Commissioner that Ms Zalewska, a Polish woman, was not entitled to income support on the grounds that she did not have a right to reside in the United Kingdom and failed the habitual residence test for income support purposes. Ms Zalewska appealed to the House of Lords - where by 4-1 majority her appeal was once more dismissed.
