R (on application of S) v Chief Constable W. Mercia Constabulary and the CRB - misleading Enhanced Criminal Record Certificate - [2008] EWHC 2811 (Admin) on 18.11.08

S, aged 49, applied for a job which required that he apply to the Criminal Records Bureau for an Ehanced Criminal Record Certificate. He expected to receive a certificate stating that he had no criminal convictions. Instead, the certificate provided details of a 2004 prosecution when he had been found not guilty of charges which had started as allegations of "outraging public decency" but were later amended to "section 5 Public Order Offences".
