Khan v Royal Mail PLC, [2006] EWCA Civ 2, Court of Appeal on 17th January 2006

The Court of Appeal held that the EAT had been correct to refuse to allow a legally represented employee to raise a new point which had not been raised in the original tribunal proceedings. In this case a claim for race discrimination and victimisation was held to have been lodged at Employment Tribunal out of time. Although an attempt was made to raise a new point about when time started to run, this attempt failed.
