YL v. Birmingham City Council & Ors - what is a "public authority" for Human Rights purposes? - House of Lords 20.6.07

By a 3 to 2 majority, the House of Lords has agreed with the Court of Appeal that a private care home does not perform the functions of a public authority for Human Rights Act 1998 s.6 purposes. In this particular case the result is that a Mrs YL cannot bring a claim that removing her from the care home was a breach of her human rights (while this is an important legal decision, it seems that in fact appropriate arrangements have been made for her).
