Carter's (Charles) Application for judicial review - smoking in public places

This is not an employment law case nor is it a British case (it comes from Northern Ireland) but is noted here as it is authority for the proposition that the laws which criminalise smoking in enclosed public spaces do not infringe individuals' Human Rights (specifically EHRC art 3 (degrading treatment); art 8 (right to private life) or Art 14 (prohibition of discrimination)).

As such it may be useful reading for those concerned with issues relating to smoking in the workplace.
