McLachlan v Early Learning Centre Ltd - fall from height and contributory negligence

On a Saturday in October 2007 Ms McLachlan fell from a ladder while attempting to retrieve a box from a high shelf in the stockroom of a Glasgow Early Learning Centre shop where she was employed as a senior sales assistant.  Early Learning Centre admitted it was in breach of Work at Height Regulations 2005, SI 2005/735 reg 6(2) but claimed that Ms McLachlan was "guilty" of contributory negligence.  She denied this and the matter came to court determine that issue and to quantify damages.
