In considering an application for "Indefinite Leave to Remain" (ILR) under immigration rule 276-O (an application by a foreign citizen who has served in the British Army) the Home Secretary must look at any negative conduct by  the applicant in a fair and considered way and must have due regard to counter-balancing positive factors.
