Aktas v Adepta (a Registered Charity) - discretionary extensions of time in personal injury cases
After a personal injury claim has been struck out for failure to serve in time, a second claim - issued out of time and arising from the same facts - can nevertheless be allowed to proceed under the discretionary extension of time provisions in Limitation Act 1980 s.33.
