Álvarez v Sesa Start España ETT SA, CJEC case C-104/09

Spanish  legislation is contrary to EU law in so far as it allows an employed father to take leave during the first nine months of his child’s life only if the child’s mother is also employed while entitling an employed mother to take such leave irrespective of the child’s father’s employment status.
