Cassidy v Department of Agriculture & Rural Development - prosecuting authority as employer

Although as a general rule prosecutors do not owe a duty of care to those they prosecute, the position can be different where an investigating/prosecuting authority is the government agency responsible for the implementation of secondary legislation which defines relevant offences and/or is also a suspect's employer.
