Zambrano v Office national de l'emploi - right of non-EU parents to reside in an EU Member State

An EU Member State must allow third country nationals to reside and work there if they have a child born there who is thereby a national of that State if refusal to allow the parents to reside would deprive that child of genuine enjoyment of the substance of the rights attaching to the status of citizen of the Union.
