Harland & Wolff Plc & Anor v McIntyre - asbestos - double recovery

Mr McIntyre died as a result of exposure to asbestos.

The employers paid money to his widow under the Fatal Accidents Act 1976. They claimed that she should not be allowed also to be paid money due under her husband's pension as this would be "double recovery". The Court of Appeal has ruled in favour of the widow on the basis that the matter was entirely about loss suffered by her in respect of her own benefit,
