Francis v Pertempts Recruitment Partnership Ltd - refusal of EAT to allow appeal to proceed is itself a decision that can be appealed

A refusal by the EAT to allow an appeal to proceed (under Rule 3(7) of its Rules of Procedure) is a "final decision or order" which can then be appealed to the Court of Appeal or Court of Session, as appropriate. Any previous suggestion that the only avenue of challenge is by way of judicial review is wrong.
