Edwards v Chesterfield Royal Hospital NHS Foundation Trust - damages can be claimed for failure to follow contractual disciplinary procedures

The House of Lords decision in Johnson v Unisys does not preclude a claim for damages based on breach of a contractual disciplinary procedure. The fundamental point is that a breach of contract outside of the actual dismissal process can sound in damages (no limit on compensation), whereas a challenge to the dismissal itself can only be undertaken via the statutory unfair dismissal process (subject to a cap on compensation).
