R. v Tointon - Courts Martial sentencing powers

A Court Martial sentence set by a panel that has had regard to the Sentencing Guidelines in force at the time of the offence(s) and notes both mitigating and aggravating factors will not be altered on appeal. Furthermore, a sentencing panel is entitled to comment on their "duty to deter others from committing [the offence of desertion]" because they are a specialist tribunal familiar with the serious operational problems caused by such offences.
