Commission v Greece - penalty for failure to enact laws to rectify breach of right to freedom of establishment

In Case C-40/03 Commission v Greece [2005] ECR I'3177 Greece was held to be in breach of Article 43 EC. It's laws prohibited "natural persons" from opening more than one optician's shop, and imposed restrictions on companies from opening opticians' shops. This was held to be a breach of the right to the Freedom of establishment. Greece was given a set period of time by the ECJ in which to pass new laws to rectify the situation.
