Gomez-Limon v INSS - parental leave directive does not apply to social security
An Advocate General has delivered an opinion in this case, which involved the amount of an invalidity pension paid by the Spanish Government. This was calculated taking into effect the salary received by Ms Gomez-Limon and the contributions made while she was taking parental leave. Both salary and contributions were substantially lower than when she ws in full-time work.
The Spanish Court referred to the ECJ the question of whether this infringes EU law. In the Advocate General's opinion, it does not.
