Commission v Austria - restriction on freedom of establishment was not justified
Austrian national law requires that, before nationals of the Member States which acceded to the EU in May 2004 can register in the commercial register partnerships or companies in which they have minority holdings, either the Arbeitsmarktservice (labour market service; 'the AMS') must determine that they are self-employed or that they have a work-permit exemption certificate.
