Barring orders preventing a person from providing services to another where he has already provided similar services in a confidential context should not be granted in an ordinary employment situation but, rather, confined to ‘solicitors and the like’. Employers should also be wary of aggressive and heavy- handed strategies when tackling perceived breaches of duty.
