Birmingham City Council v Abdulla - civil court can consider equal pay claim that is out of time in employment tribunal

The fact that time limits have expired in respect of an Equal Pay claim in the Employment Tribunal is a relevant and weighty consideration when a civil court is exercising its discretion to strike out an equal pay claim on the grounds that it could be "more conveniently disposed of" by an employment tribunal. Depriving claimants of a decision on merits in either forum was not what Parliament intended.
