O'Brien v Ministry of Justice - are judges workers? If so is unequal treatment in respect of judicial pensions justified?

The Part Time Workers Regulations 2000 exclude "holders of judicial office" from claiming unequal treatment under the Regulations. The Supreme Court must determine whether part-time judges in fact fall within the UK definition of "worker" such that the Regulations do apply to them and, if so, whether unequal treatment in respect of pensions may be justified.
