Seldon v Clarkson Wright and Jakes - the justification of direct age discrimination
The scope of justification of direct age discrimination is more limited than in other indirect discrimination claims: (1) the "legitimate aim" must be one connected to certain social policies; (2) it must be such a legitimate aim in the particular circumstances of the employment concerned; and (3) an assessment of whether the means of achieving that aim were "appropriate and necessary" includes ascertaining whether there existed other, less discriminatory, means of doing so.
