Homer v Chief Constable of West Yorkshire Police - indirect age discrimination, and disadvantage suffered for reason directly connected to age

When considering a claim of indirect age discrimination, it is unrealistic to compare people who suffer a disadvantage when a provision, criterion or practice is applied to them that is for a reason directly related to age (such as compulsory retirement) with those who suffer disadvantage from the same PCP due to their impending leaving of employment for other reasons (particularly reasons of choice).
