R & R Plant (Peterborough) Ltd v Bailey - retirement under the old statutory requirements
The now-repealed statutory retirement procedures under the Employment Equality (Age) Regulations 2006 require that, when an employer gives written notice of its intention to retire an employee, that written notice specifically explains to the employee the that he has the statutory right to request to be kept on under Schedule 6 paragraph 5 of the Regulations. It would be good practice to further explain the mandatory requirements under that paragraph, although there is no legal obligation to go that far.
