Liffe Administration and Management v Pinkava & anor - patent ownership of invention by employee - Court of Appeal 15.3.07

The Court of Appeal has upheld last year's High Court ruling in this case, albeit on slightly different grounds. The fact that neither an employer nor employee anticipated that the latter would come up with a patentable invention during the course of carrying out a task assigned to him by the employer does not detract from the employer's rights to ownership under the Patents Act 1977; Neither the size of the invention nor the fact that it is radical, ground breaking and clever affect this position.
