Test for suitable alternative employment is subjective

This is an appeal by Devon PCT against decisions of the EAT. In its first decision the EAT allowed the appeal and substituted a finding that Ms Readman was entitled to receive a statutory redundancy payment and its second decision refused an application to review that decision. Subject to liability, the redundancy payment was agreed at £8,575 but further claims may turn on the outcome of the appeal.
