Seldon v Clarkson, Wright & Jakes - partnership justified in requiring partners to retire at age 65
A partnership can justify a requirement that partners must retire at a specified age, in this case 65, if this can be shown to be a proportionate means to achieve a legitimate aim and for this purpose the legitimate interests of the partnership as a business can constitute a legitimate aim - it is NOT necessary for a private partnership to show legitimate social policy objectives.
