Leach v Ofcom - lack of honesty could breach trust and confidence and amount to SOSR for dismissal
Dismissal decision, based on SOSR in employee's failure to be honest about child abuse allegations even though criminal proceedings had not been completed, was fair in the circumstances of the case.
Mr Leach was recruited for a senior post with Ofcom. Before taking up the post, he was arrested in Cambodia on child sex abuse charges. He did not disclose this to Ofcom.
