The main issue in this case was whether Directive 98/59/EC (the Collective Redundancies directive which provides for information and consultation rights where collective redundancies are proposed) confers those rights directly on workers and, if so, whether the rights are individual or collective. 'Collective redundancies` is defined as meaning dismissals effected by an employer for one or more reasons not related to the individual workers concerned, subject to minimum numbers (in the UK, 20 over a period of 90 days).
