Charlton v DWP, [2009] EWCA Civ 42 - capability to work and social security benefits

This case concerned the proper interpretation of a regulation governing whether a benefit claimant is to be treated as incapable of work because there would be a substantial risk to his own or another's health if he were found capable of work (Social Security (Incapacity for Work) (General) Regulations 1995, SI 1995/311 reg 27(b)).
