Governing Body of St Albans Girls' School & anor v Neary - tribunals are not courts so are not bound by the Civil Procedure Rules (notably rule 3.9)

CPR 3.9 (which sets out factors to be taken into account in considering whether or not to grant relief from sanctions imposed for failure to comply with rules, practice directions and court orders) is of direct application in the High Court or County Court, but NOT in the employment tribunal. Previous decisions are wrong to the extent that they suggest the contrary.
