Gutridge & Ors v Sodexo & Anor - time limit for equal pay claim in relation to transferor, albeit against transferee, runs from date of TUPE transfer

Cleaners, including Mrs Gutridge, employed by the Trust until July 2001 transferred, under TUPE, to Sodexo. They brought equal pay claims in December 2006, arguing that the equality clause implied into employment contracts by the Equal Pay Act 1970 gave them a contractual entitlement which the Trust was obliged to honour, and so that transferred to Sodexo - against whom they sought to enforce it. An employment tribunal found in their favour and Sodexo (name changed from "Sodexho") appealed, arguing that the claims were out of time.
