O'Brien v Department for Constitutional Affairs - judicial office holders are not covered by part-time workers regulations

Mr O'Brien sat as a part-time Recorder from 1978 until he retired in March 2005. He argued that he should be entitled to a pro-rata'd judicial pension on his retirement, and that the fact that he did not receive one amounted to unlawful discrimination against him as a part-time worker.
