Samuels v London Bus Services Ltd and Unite - detriment under Trade Union and Labour Relations (Consolidation) Act 1992 s.146(3)

On particular facts a deduction from wages was a payment forced on an employee because he was not a member of a trade union.  It was thus a breach of his statutory right not to be subjected to a detriment by being required to make a payment because he was not a member of a trade union (TULRCA 1992 s.146(3) and (4)).
