Newbury v Sun Microsystems - binding settlement made in correspondence

Litigation can be settled in correspondence, even where that correspondence notes that the terms will be recorded in "a suitably worded agreement": if there is offer and acceptance, and an absence of the phrase "subject to contract", the necessary ingredients for a binding contract may be present.

Mr Newbury embarked on a contractual commission claim against Sun Microsystems.
