Smith, R (on the application of) v Secretary of State for Defence & Anor - ECHR does not cover troops fighting abroad

Once UK troops fighting are no longer in a UK base, then they no longer come under the protection of the ECHR: the fact that the UK's forces, when fighting abroad, come under the authority and control of the UK does not alter this, because the ECHR is based on territorial jurisdiction.
