Riley v The Crown Prosecution Service - medical condition prevented fair trial being possible within reasonable time: strike-out justified

Where medical evidence cannot offer any realistic chance that a medical condition, which is preventing a tribunal hearing from being held, will improve within a reasonable time, it is open to an Employment Judge to strike out the claim on the basis that a fair trial is not possible.
