Annette Radke v Achterberg Service GmbH & Co - collective redundancies, timing of notices of dismissal - ECJ Case C-115/06 (Reference)

The result of the ECJ case of Junk v Wolfgang K├╝hnel, ECJ case C-188/03 on 27th January 2005 was that if collective redundancies are proposed it may be unlawful for an employer to give any notices of dismissal until the required period of consultation (90 or 30 days depending on the number of employees involved) has been completed. This case seeks clarification of the position.
