Strachan v Railtrack Plc - railway track is not an engine driver's work equipment - Scottish Court of Session 13.6.07

Mr Strachan was a train driver. His train when collided with a rock on the line and he claimed that as a result he developed post-traumatic stress disorder. He claimed damages from Railtrack Plc on the basis that they failed to take reasonable care to ensure that rocks did not fall on to the line and has been given permission to pursue that claim. He also claimed that Railtrack were in breach of the Provision and Use of Work Equipment Regulations 1992 regs 5 & 6.
