Commission of the European Communities v UK - UK wins Health & Safety case - ECJ Case C-127/05, 14.6.07

The European Commission took the view that Britain had not properly implemented Directive 89/391/EEC because it requires employers to ensure the health and safety of employees only "so far as is reasonably practicable" (SFAIRP) (H&S at W etc Act 1974 s.2). The Commission therefore brought a case in the European Court of Justice against the UK.
