Clyde & Co LLP & Anor v Winkelhof - arbitration clause was not capable of prevent tribunal proceedings

An agreement to exclude the right to bring employment tribunal proceedings must meet the strict statutory requirements necessary to be effective: an arbitration clause in a partnership agreement was not capable of excluding such rights and therefore not capable of supporting an injunction to prevent the bringing of a claim.
