Gibb v Maidstone & Tunbridge Wells NHS Trust - agreed payment was NOT irrational: High Court must not act as auditor or substitute its own view
Contrary to the view of the High Court, agreement to pay a £250,000 severance package was neither irrational nor ultra-vires. A Court must take care when judicially reviewing such decisions not to get drawn into acting as an auditor and substituting its own views on the figures agreed in such circumstances.
