Parkwood Leisure v Alemo-Herron & 23 others - transferee employer only bound by collective agreements in place on date of TUPE transfer

Where an employee's employment has been transferred to a new employer by reason of a TUPE transfer and his or her terms of employment incorporate terms of a collective agreement, the new employer does not need to give effect to a pay increase agreed under that collective agreement if that pay increase was agreed after the TUPE transfer has taken place. This Court of Appeal decision overrules that of the Employment Appeal Tribunal.
