Jervis and KST Investments Ltd v Skinner - findings of fact are generally not appealable

A second appellate court should interfere with a judge's findings of fact only if it finds that there has been a miscarriage of justice or relevant error of principle.

Mr Skinner was employed by KST Investments Ltd, a company which belonged to his former friend, Mr Jervis.  His job was to assist with the building and development of 76 houses, collectively known as 'Shoreline', in the Bahamas.
